On September 9, 2021, the Biden Administration released the Path Out of the Pandemic: COVID-19 Action Plan (Executive Order 14042) announcing mandatory vaccinations for Federal employees. On September 24, 2021, the Safer Federal Workforce Task Force, composed by the White House COVID-19 Response Team, the General Services Administration (GSA), and the Office of Personnel Management (OPM), released its guidance on the Executive Order (EO). This guidance details the compliance mechanism for all federal contractors, subcontractors, and their employees. It is important to note that the EO does not provide the option of submitting a weekly test.

In response to President Biden’s EO, AGC of California has developed two documents to help all of our members navigate, comply, and safeguard their rights from the requirements outlined in the Safer Federal Workforce Task Force Guidance.

AGC of America has engaged outside counsel to evaluate all legal options to challenge these requirements and received a legal memorandum in order to guide further action.  AGC of California will continue to work closely with AGC of America, advocate for all our members’ priorities, and update members in a timely manner as Federal Guidance and FAQs are revised. For more on vaccine mandates, please stay tuned for an AGC of California WebEd to keep members up-to-date.
